Agent commission is paid by the seller
In Spain it is standard for the seller to pay the agent commission — not the buyer. As a buyer you do not pay directly for the agent's service, but be aware that the commission (typically 3-6% of the sale price) is built into the price you see advertised.
What is a typical agent commission?
Commission varies and is not legally regulated in Spain:
- Standard Spanish agents: 3-5% of the sale price
- International agents (Marbella, Alicante): Often 5-6%, occasionally up to 10% for exclusive properties
- Fixed commissions: Some agents charge a flat fee rather than a percentage for cheaper properties
Are Spanish estate agents regulated?
This is an important difference from many other countries: Spain has historically not had a legally regulated estate agent profession. The title "agente inmobiliario" is not protected, and in principle anyone can call themselves an estate agent. The industry is professionalising, however, and many serious agents are certified via API (Agentes de la Propiedad Inmobiliaria) or similar organisations.

Important point: The agent represents the seller — not you as the buyer. Your independent lawyer represents you. Never use the agent's suggested lawyer or notary as your sole legal advisor.

Yes — commission is negotiable. In a buyer's market (many properties for sale) you can often negotiate the commission down. In a seller's market (high demand) agents are typically more reluctant to discount.
